1Introduction
These Website Terms & Conditions govern your access to and use of www.lmtmusicacademy.co.uk (the “Website”), including any purchases made through it.
The Website is owned and operated by London Music Teachers Ltd, a company registered in England and Wales under company number 12240117, trading as LMT Music Academy (the “Academy”, “we”, “us” or “our”).
By accessing or using the Website, you agree to comply with these Terms & Conditions. If you do not agree, you should refrain from using the Website.
These terms do not affect your statutory rights as a consumer.
2Relationship with Our Course Terms & Conditions
The Academy provides music education services, including individual and group lessons, introductory lessons and other music-related activities.
Enrolment in an ongoing music course is governed by our separate Course Terms & Conditions, which set out the applicable arrangements for:
- Course commitments and lesson schedules;
- Tuition fees and recurring payments;
- Lesson rescheduling and cancellations;
- Teacher substitutions;
- Membership termination and notice periods; and
- Other obligations relating to ongoing music courses.
These Website Terms & Conditions apply to the use of the Website and online purchasing arrangements.
Where the Course Terms & Conditions contain more specific provisions concerning an ongoing course, those provisions shall govern that course, subject always to applicable consumer protection legislation.
3Intellectual Property
Unless otherwise stated, all content published on the Website, including text, photographs, graphics, logos, designs, videos, documents and other materials, is owned by or licensed to London Music Teachers Ltd.
Such content is protected by applicable copyright, trade mark and other intellectual property laws.
You may access, view and print Website content for your personal, non-commercial use.
You must not reproduce, distribute, modify, republish, commercially exploit or otherwise use Website content without our prior written permission, except where permitted by law.
Nothing in these Terms & Conditions transfers any intellectual property rights to Website users.
4Acceptable Use
You agree to use the Website lawfully and responsibly.
You must not:
- Use the Website for any unlawful, fraudulent or misleading purpose;
- Attempt to gain unauthorised access to the Website, its systems or other users’ accounts;
- Introduce viruses, malicious software or other harmful material;
- Interfere with the security, operation or availability of the Website;
- Infringe the intellectual property rights of the Academy or any third party;
- Harass, threaten or otherwise unlawfully mistreat other Website users; or
- Use automated systems to extract Website content or data without authorisation, except where permitted by law.
Where we reasonably believe that these conditions have been breached, we may restrict or suspend access to the Website and take appropriate action.
Any such action shall be proportionate to the circumstances and shall not affect rights that cannot lawfully be excluded.
5Information on the Website
We endeavour to ensure that the information published on our Website is accurate, clear and up to date.
However, information relating to lesson availability, teachers, timetables, prices and services may change.
Where such information forms part of a confirmed contract, it will remain binding to the extent required by applicable law and the terms of that contract.
We shall not be responsible for minor typographical errors that do not materially affect a purchase, but we will correct identified errors as soon as reasonably practicable.
Nothing in this section excludes any rights arising under the Consumer Rights Act 2015.
6Sale of Services
The Academy may offer the following services and products through its Website:
- Individual music lessons;
- Group music lessons;
- Introductory lessons and assessments;
- Ongoing music courses;
- Gift vouchers; and
- Other music education services advertised from time to time.
The principal characteristics and applicable prices of each service will be displayed or otherwise communicated before the customer completes the purchase.
All services shall be supplied with reasonable care and skill and in accordance with the applicable contractual terms.
The Academy reserves the right to decline a new booking where, for example, the requested service is unavailable, the information provided is materially incorrect or a payment cannot be authorised.
Where we are unable to accept or fulfil a paid order, we will notify the customer and arrange a refund of any amount paid for services that will not be supplied.
7Prices and Payments
Prices for services and products are displayed on the Website or provided to customers before purchase.
Any applicable taxes, compulsory fees and other charges will be disclosed before the customer becomes bound by an order.
We may accept payments through:
- Debit and credit cards;
- Direct Debit; and
- Other payment methods made available during checkout.
The available payment methods may vary according to the service purchased.
By providing payment details, you confirm that you are authorised to use the chosen payment method and authorise the collection of the applicable amount in accordance with the agreed payment terms.
One-off purchases may require payment in full when the order is placed.
Ongoing music courses are subject to their separately agreed payment arrangements, including any applicable monthly Direct Debit.
We may use authorised third-party payment providers to process transactions securely.
8Ongoing Courses and Recurring Payments
Where you enrol in an ongoing music course, your membership and payment arrangements shall be governed by the applicable Course Terms & Conditions and your enrolment agreement.
Recurring payments will continue in accordance with those arrangements until the membership is validly terminated.
Students wishing to terminate their ongoing courses must follow the notice requirements set out in the Course Terms & Conditions.
Notice may be submitted in writing to: contact@lmtmusicacademy.co.uk
Cancellation of a payment instruction or Direct Debit mandate does not, by itself, terminate an existing course agreement or discharge any outstanding contractual obligations.
Nothing in this clause restricts a student’s statutory cancellation rights or other rights arising under applicable consumer protection legislation.
9Gift Vouchers
Gift vouchers purchased through the Website may be redeemed against eligible services provided by the Academy, subject to the conditions communicated at the time of purchase.
Any applicable validity period, redemption restrictions or service-specific conditions will be disclosed before purchase.
Gift vouchers have no cash redemption value except where a refund is required by law.
Bookings made using gift vouchers remain subject to the relevant service conditions, including availability and any applicable rescheduling requirements.
Where a gift voucher is purchased online, statutory cancellation rights will apply where required by law.
Nothing in this section excludes any mandatory rights or remedies available to consumers.
10Statutory Right to Cancel
Where you enter into a qualifying distance contract with the Academy, including certain purchases made online, by email or by telephone, you may have a statutory right to cancel without giving a reason.
For qualifying service contracts, the cancellation period is generally 14 days beginning on the day after the contract is entered into.
Certain contracts and services may be exempt from this right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Any applicable exemption will be assessed according to the nature of the particular purchase and the relevant statutory requirements.
Where the statutory cancellation right applies, you may exercise it by informing us of your decision before the cancellation period expires.
You may contact us by:
Email: contact@lmtmusicacademy.co.uk
Post: LMT Music Academy, 60–62 Great Titchfield Street, London W1W 7QF
You may use the Model Cancellation Form provided at the end of these Terms & Conditions, but you are not required to do so. Any clear statement communicating your decision to cancel will be sufficient.
This statutory cancellation right is separate from the contractual notice requirements applicable to ongoing music courses.
11Lessons Beginning During the Cancellation Period
If you wish to begin receiving lessons or other services before the applicable 14-day cancellation period expires, the Academy may ask you to make an express request for early commencement.
Where you have expressly requested early commencement and subsequently exercise a valid statutory cancellation right, you may be required to pay a proportionate amount for services already supplied, in accordance with the Consumer Contracts Regulations 2013.
Where the service has been fully performed during the cancellation period following your express request and the legally required acknowledgement, your statutory right to cancel that service contract may be lost.
Any payment obligation or loss of cancellation rights will apply only where the relevant statutory conditions have been satisfied.
12Refunds
Where a customer validly exercises a statutory right to cancel, any refund due will be processed in accordance with applicable consumer legislation.
For qualifying cancellations, refunds will generally be made within 14 days after we are informed of the cancellation, subject to any lawful deduction for services already supplied.
Refunds will ordinarily be made using the original payment method unless the customer expressly agrees otherwise.
No fee will be charged solely for processing a statutory cancellation refund.
Outside any applicable statutory cancellation period, refunds relating to ongoing courses shall be considered in accordance with the Course Terms & Conditions and applicable law.
Nothing in these Terms & Conditions prevents customers from exercising statutory remedies where services are not supplied, are not provided with reasonable care and skill, or otherwise fail to meet applicable legal requirements.
13Consumer Rights
The Academy is committed to complying with applicable consumer protection legislation, including the Consumer Rights Act 2015.
Services shall be provided with reasonable care and skill. Information supplied by the Academy about its services will be binding where required by law.
Nothing in these Terms & Conditions excludes or restricts rights or remedies that cannot lawfully be excluded or restricted.
If there is any inconsistency between these Terms & Conditions and mandatory consumer protection legislation, the relevant statutory provisions shall prevail.
14Third-Party Websites and Services
The Website may contain links to websites, payment services, platforms or resources operated by third parties.
These links are provided for information or convenience.
We do not control the content or operation of independent third-party websites and are not responsible for their separate terms, policies or practices, except where responsibility arises under applicable law.
Customers should review the relevant terms and privacy policies when accessing third-party services.
Nothing in this section limits our legal responsibilities in relation to third parties acting on our behalf.
15Website Availability
We aim to maintain a reliable and accessible Website.
However, temporary interruptions may occur due to maintenance, technical difficulties, security requirements or circumstances outside our reasonable control.
We may suspend or modify parts of the Website where reasonably necessary for maintenance, operational improvements or security.
Where practicable, we will seek to minimise disruption.
We do not guarantee uninterrupted access to the Website, but this provision does not limit any contractual or statutory rights arising from services purchased through it.
16Limitation of Liability
Nothing in these Terms & Conditions excludes or restricts our liability for:
- Death or personal injury caused by negligence;
- Fraud or fraudulent misrepresentation;
- Breach of statutory consumer rights where liability cannot lawfully be excluded; or
- Any other liability that cannot lawfully be excluded or restricted.
Subject to those protections, we shall not be responsible for losses arising from Website interruptions, unauthorised third-party activity or events outside our reasonable control where such losses are not attributable to a breach of our legal obligations.
We shall remain responsible for losses that are a foreseeable consequence of our breach of contract or failure to exercise reasonable care and skill, to the extent required by law.
Nothing in this clause affects your statutory rights or remedies.
17Website Security and User Responsibility
Users are responsible for taking reasonable precautions when accessing the Website, including maintaining appropriate security measures on their devices.
Where an account is provided, users must take reasonable steps to protect their login credentials and must not knowingly permit unauthorised access.
If you become aware of suspected unauthorised access involving your account, please inform us promptly.
You shall not be responsible for unauthorised activity caused by the Academy’s own failure to comply with its legal obligations.
18Privacy and Personal Data
We process personal information in accordance with applicable data protection legislation, including the UK General Data Protection Regulation and the Data Protection Act 2018.
Further information about the collection, use, storage and protection of personal data is available in our Privacy & Cookie Policy.
Use of the Website does not require you to consent to optional marketing communications.
Any marketing preferences and cookie consent arrangements will be managed in accordance with applicable law.
19Changes to These Terms & Conditions
We may amend these Website Terms & Conditions to reflect changes in legislation, regulatory requirements, Website functionality or our business operations.
The current version will be published on the Website together with its effective date.
Changes shall apply prospectively and shall not retrospectively alter existing contracts, remove accrued rights or impose additional obligations without a lawful basis.
Where a change materially affects an existing contractual relationship, we will provide any notice or obtain any agreement required by applicable law or the relevant contract.
20Governing Law and Jurisdiction
These Terms & Conditions are governed by the laws of England and Wales.
Any dispute shall be subject to the jurisdiction of the courts of England and Wales, except where applicable consumer protection legislation entitles a consumer to bring proceedings in another competent jurisdiction.
Nothing in this clause deprives consumers of any mandatory legal protections available to them.
21Severability
If any provision of these Terms & Conditions is found to be unlawful, invalid or unenforceable, that provision shall be treated as ineffective to the extent required by law.
The remaining provisions shall continue to apply insofar as they remain lawful and enforceable.
